Terms & Conditions

• Platform Provider Only: SewaJer is an online marketplace platform that connects independent vehicle owners ("Owners") with individuals seeking to rent vehicles ("Renters").
• No Ownership or Control: SewaJer acts solely as a technology platform that facilitates the listing and discovery of vehicles. SewaJer does not own, operate, manage, rent, lease, or control any vehicles listed on the platform.
• Third-Party Status: SewaJer is NOT a car rental agency, rental broker, or insurer. SewaJer is not a party to any rental agreement entered into between an Owner and a Renter.
• Access Availability: Access to this platform is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice.

Any rental agreement, written or verbal, is entered into directly between the Owner and the Renter. SewaJer heavily disclaims any liability arising from such agreements.

• The Owner is solely responsible for:
  • The accuracy, truthfulness, and legality of vehicle information and listings.
  • Vehicle condition, maintenance, safety, and roadworthiness.
  • Vehicle availability at the agreed time and location.
  • Compliance with all local applicable laws (including valid commercial insurance and registration).
  • Any refund, compensation, security deposit returns, or dispute arising from the transaction.
• The Renter is solely responsible for:
  • Verifying the vehicle’s suitability, condition, and documentation before making any payments.
  • Possessing and maintaining a valid driving licence.
  • Complying with all rental terms agreed directly with the Owner.

• Rental Transactions Are Direct & Outside the App: SewaJer does not process, receive, hold, manage, facilitate, or control any rental fees, deposits, or cash handovers between an Owner and a Renter. Any and all financial arrangements for a rental are transacted directly between the Owner and the Renter outside of the SewaJer platform.
• Owner Financial Responsibility (Rentals): The Owner is solely and exclusively responsible for issuing refunds, resolving payment disputes, and returning deposits arising from a rental transaction with a Renter.
• No Platform Liability (Rentals): SewaJer shall NOT be liable for any financial loss, fraud, or online scams arising from a rental transaction. If a Renter pays a deposit to an Owner and the vehicle is not provided, or a refund is withheld, SewaJer will NOT provide any financial compensation or refund.
• Subscription Payments (Owners): Unlike rental payments, Owner subscription/plan payments made to SewaJer (for listing plans, AI feature credits, or other paid features) are processed through CHIP Collect, a licensed third-party payment gateway. SewaJer does not store your full payment card, bank, or e-wallet credentials — these are collected and processed directly by CHIP Collect.
• All Subscription Payments Are Non-Refundable: Once a subscription or plan payment has been successfully processed via CHIP Collect, it is final and non-refundable, including where you subsequently downgrade, cancel, or stop using your subscription before the end of its billing period, except: (i) where required by applicable Malaysian consumer protection law, or (ii) where SewaJer determines, at its sole discretion, that a duplicate or erroneous charge occurred due to a technical error on our part or on the part of CHIP Collect. Approved corrections will be processed back through CHIP Collect to the original payment method.
• No Platform Liability (Subscriptions): Except for the limited correction described above, SewaJer shall not be liable for any loss arising from a subscription payment, including failure to use the subscribed features, accidental purchase, or dissatisfaction with the plan purchased.

• AI-Assisted Listings: SewaJer may use AI-based image recognition technology, including third-party AI service providers, to help Owners auto-detect vehicle details (such as brand, model, and visible condition) from photos uploaded during listing creation or updates.
• Convenience Feature Only, No Warranty: AI-generated suggestions are provided "as is" as a convenience feature only. SewaJer makes no warranty or guarantee as to the accuracy, completeness, or reliability of any AI-generated output.
• Owner Responsibility: The Owner remains solely responsible for reviewing, verifying, and correcting all vehicle listing information — including any details suggested by AI — before publishing a listing. AI output does not constitute a vehicle inspection, valuation, or roadworthiness certification.
• No Liability for AI Output: SewaJer shall not be liable for any loss, dispute, or damage arising from inaccurate, incomplete, or misleading AI-generated suggestions, or from an Owner's reliance on such suggestions without independent verification.
• Usage Limits: Use of the AI feature may be limited or rate-limited, including based on your subscription plan, and may be modified, suspended, or discontinued at any time without notice.

• No Guarantee: Verification checks do not constitute a guarantee, endorsement, or warranty by SewaJer regarding the Owner’s identity, vehicle condition, legality, or suitability.
• Assumption of Risk: Users remain completely responsible for conducting their own due diligence and identity verification before transferring any funds.

You must not misuse this platform. Users agree NOT to:

• Provide false, inaccurate, or misleading profile or vehicle information.
• Use the platform to commit or encourage a criminal offense, or engage in fraudulent activities.
• Hack into any aspect of the Service, corrupt data, or cause annoyance to other users.
• Circumvent the platform for unlawful purposes or misrepresent vehicle ownership.

Breaching these provisions constitutes a criminal offense, and SewaJer will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

To the fullest extent permitted by law, SewaJer shall not be liable for any damages whatsoever, including but not limited to direct, indirect, or consequential damages arising out of or related to:

• Vehicle unavailability or sudden cancellations by Owners or Renters.
• The total failure of an Owner to provide a vehicle after receiving payment.
• The failure or refusal of an Owner to issue a refund or return a security deposit for a rental transaction.
• Vehicle defects, mechanical breakdowns, or safety failures.
• Accidents, traffic offenses, property damage, or theft of the vehicle.
• Personal injury, medical emergencies, or death resulting from the use of any listed vehicle.
• Inaccurate or incomplete AI-generated listing suggestions (see Section 4).

Any claim relating to a rental transaction or physical vehicle shall be pursued directly between the Owner and the Renter.

• SewaJer is under no legal obligation to mediate, arbitrate, investigate, police, or resolve disputes between Owners and Renters.

You agree to indemnify, defend, and hold harmless SewaJer from any and all third-party claims, liability, damages, and/or costs (including legal fees) arising from your use of this platform or your breach of these Terms.

• SewaJer reserves the right to suspend, remove, or permanently terminate any account or vehicle listing without notice if we suspect fraudulent, suspicious, or deceptive conduct.

Personal information collected by SewaJer shall be processed strictly in accordance with the SewaJer Privacy Policy. By using this platform, you warrant that all data provided by you is accurate.

The intellectual property rights in all software and content made available to you remains the property of SewaJer and are protected by copyright laws. You are not permitted to publish, manipulate, or distribute any of the content for commercial enterprise.

• SewaJer has no control over Linked Sites and accepts no responsibility for them. All third-party trademarks featured are owned by their respective owners.

If any part of these Terms is unenforceable, the enforceability of any other part will not be affected, and all other clauses shall remain in full force and effect.

• If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding agreements between you and SewaJer App.
